Terms & Conditions – ONA Rewards

1. MY ONA REWARDS PROGRAM’S MANAGER

The manager for the My Ona Rewards Program (“My Ona Rewards Program”) is The Argentine Trading Company Ltd., trading as Ona Polo, a company incorporated in England and Wales with company number 03939970 whose registered office is at 101 Bartholomew Road, London, NW5 2AR (“Ona”).

2. MY ONA REWARDS PROGRAM MEMBERSHIP

The My Ona Rewards Program offers loyalty points based on purchases made in the online store www.onapolo.com (the “Ona Website”), and permits the purchaser to use these loyalty points towards future purchases.

Any individual who has purchased products on the Ona Website, may join the My Ona Rewards Program (“Member”). There are no fees to join, but loyalty points are only awarded for purchases on the Ona Website.

A Member must create an account on the Ona Website and provide the following mandatory information:

– First Name
– Last Name
– Email address
– Date of Birth
– Consent or refusal to receive Ona communications

Membership to the My Ona Rewards Program is completely paperless, so no physical card will be given to a Member.

A Member is subject to My Ona Rewards Program Terms and Conditions, the Ona Website’s General Terms and Conditions of Online Sales, the Ona Website’s Personal Data Protection Policy, and the Ona Website’s Cookie Policy, as amended from time to time.

3. MY ONA REWARDS PROGRAM LOYALTY POINTS

3.1. Earning loyalty points

For each purchase of a product made on the Ona Website, loyalty points are earned as follows:

In Europe (excluding UK):

1 Pounds Sterling spent = 1 loyalty point earned

The amount of loyalty points earned when purchasing products is calculated based on the total amount excluding delivery costs, when applicable.

In the UK:

Please note, for UK Members only, the number of loyalty points arising upon a purchase will display in the Member’s Account as 80% of the awarded loyalty points, however, upon redeeming loyalty points, the Member will receive credit of an additional 20% loyalty points towards their purchase.

In the rest of the world:

1 US Dollars spent = 1 loyalty point earned

The amount of loyalty points earned when purchasing products is calculated based on the total amount excluding delivery costs, when applicable.

The loyalty points earned are rounded up to the nearest whole number.

There is no limit as to the number of loyalty points you can earn.

3.2. Using loyalty points

The account is personal and for the sole use of the Member. A Member (same name, same email address) may only sign up once to the My Ona Rewards Program: multiple accounts are prohibited. In addition, the same email address can only be associated with one account.

The My Ona Rewards Program is reserved for individuals who purchase on the Ona Website for their own, non-professional or business use.

A Member may not use multiple offers to make a purchase. For example: a Member cannot use a discount coupon and loyalty points on the same purchase.

A Member may not assign or transfer, in any way whatsoever, all or part of their rights and/or obligations under the My Ona Rewards Program. Loyalty points are associated with a particular Member only and are therefore non-transferable and non-assignable.

The purchase of a gift card on the Ona Website is included when calculating the amount of loyalty points earned, but purchases paid for with a gift card will not earn loyalty points.

Loyalty points cannot be used for taxes or any kind of fees including, packaging fees, shipping & handling or delivery charges. Loyalty points are not earned on taxes nor fees. Other exclusions may apply during special promotions.

Loyalty points have no cash value and cannot be exchanged for cash or credit. You have no ownership interest in points, and these loyalty points do not constitute property. The use of the word “earn” or similar language in marketing materials and these rules in relation to the My Ona Rewards Program does not imply that the loyalty points have any value prior to conversion or redemption. Loyalty points may not be purchased or sold and are not transferable.

Loyalty points are valid for 12 months from the date of purchase. For example, if a Member makes a purchase on January 15th, the loyalty points earned from that purchase will expire on January 14th of the following year.

When a Member has loyalty points with different expiration dates and wishes to use loyalty points, the earliest expiring loyalty points shall be used first.

The loyalty points used are distributed over all the products of the order in proportion to the price of the products. Thus, in case of a return, the loyalty points will be credited again in proportion to the price of the returned product(s).

In the case of a return, the loyalty points earned on such product will be removed from the Member’s account.

Loyalty points not used in whole or in part may not give rise to any refund, even partial, or exchange, nor to any monetary consideration in any form whatsoever. If orders or products purchased in whole or in part with loyalty points are cancelled or returned, the loyalty points used will be credited back to the Member’s account.

A Member can use loyalty points with no minimum purchase amount and no minimum threshold of loyalty points earned. Members can thus pay for all or part of an order excluding delivery costs.

Loyalty points cannot be used to pay for:

– Delivery costs. Please note that if using the loyalty points reduces the order amount below the free delivery threshold (if applicable), the Member will be required to pay the delivery costs.

3.3. Loyalty points value (according to the country you are in)

10 points earned = 1 Pound Sterling discount to be used towards your next purchase on the Ona Website.

10 points earned = 1 US Dollar discount to be used towards your next purchase on the Ona Website.

3.4. Checking loyalty points

A Member can check the loyalty points balance, track the totals and the use of loyalty points by logging into their account and going to the “Loyalty Points History” section on the Ona Website.

4. PERSONAL DATA

When creating an account, a Member must fill out the following mandatory information:

– First Name
– Last Name
– Email address
– Date of Birth
– Consent or refusal to receive Ona communications.

The date of birth is mandatory and enables the Member to benefit from Birthday Offers. If the birth date on the account is incorrect, only one change will be allowed and a copy of the Member’s ID may be requested for any additional change.

A Member is responsible for the accuracy of the data provided for creating an account and joining the My Ona Rewards Program. A Member is responsible for keeping the information up-to-date by updating the data on the Ona Website.

Ona shall in no way be liable if a Member does not receive any communications, invitations, offers, or products sent to a Member under the My Ona Rewards Program due to inaccurate or outdated information.

The information collected shall be processed by computer for the following purposes:

– managing the My Ona Rewards Program (legal basis: Ona’s legitimate interest).

– promoting and personalising various communications (digital, email, post, SMS) from Ona (legal basis: Ona’s legitimate interest).

– producing sales statistics (legal basis: Ona’s legitimate interest).

The controller of these data processing is Ona. The data may be sent to Ona’s service providers selected by Ona for running the My Ona Rewards Program and managing customer accounts.

The data will be kept for a period of time that enables Ona to comply with its legal obligations or for a maximum of three years from the last purchase/contact.

A Member also has the right to file a complaint with the relevant supervisory authority.

5. CHANGES AND TERMINATION

Ona shall do its best to ensure that the My Ona Rewards Program operates smoothly, but cannot be held liable for any malfunctions or errors in the My Ona Rewards Program.

Ona reserves the right in its sole discretion, to modify, add or delete any of the My Ona Rewards Program rules, terms, conditions, or benefits, in whole or in part, at any time, with or without notice, even though such changes may reduce (or increase) the value of the My Ona Rewards Program offers or a Member’s benefits.

Ona reserves the right to modify, suspend or terminate the Program provided that Members are notified in advance within 60 days. No change, suspension, or cancellation of the My Ona Rewards Program shall entitle any Member to compensation.

The latest version of the conditions applicable to the My Ona Rewards Program is available on the Ona Website.

Continued participation in the My Ona Rewards Program constitutes acceptance of any modifications, additions or deletions. All questions and interpretations concerning the My Ona Rewards Program shall be resolved in the sole discretion of Ona and, by joining the My Ona Rewards Program, participants expressly agree to be bound by Ona’s decisions.

Ona reserves the right to suspend or deactivate a Member’s account, which will lead to the points earned being cancelled, and the Member shall not be able to claim any compensation whatsoever.

6. APPLICABLE LAW AND JURISDICTION

The validity, construction and performance of the My Ona Rewards Program shall be governed by English Law. Any dispute arising under or in connection with the My Ona Rewards Program shall be subject to the exclusive jurisdiction of the English courts to which Ona and the Member hereby submit.
